Terms of Service
Effective date: 26 May 2026
These terms govern your use of StockIt. By creating an account or using the service you agree to be bound by them. If you don’t agree, don’t use StockIt.
1. The agreement
This is an agreement between Mw Technologies( “we”, “us”, “our”), which operates the StockIt application, and the organization that registers an account on StockIt (“you”, “your organization”). When an individual user signs in, they act on behalf of their organization and confirm they have authority to bind it.
2. The service
StockIt is a cloud application that helps small and medium businesses manage inventory, sales, customers, employees, and expenses across one or more branches. The service is delivered as-is and may evolve — we may add, change, or remove features. We will give reasonable notice before removing material features that paying customers rely on.
3. Your account
- You must provide accurate information when registering.
- You are responsible for keeping the Google account that signs into StockIt secure, and for everything done under your organization’s account.
- The first person to sign in to your organization is its admin and may invite, promote, demote, and remove other users.
- You must promptly notify us at the address in Section 14 if you suspect unauthorized use of the account.
4. Subscription, billing, and trial
New organizations receive a free trial of 14 days. After the trial ends you must subscribe to continue using StockIt. Subscriptions are billed monthly via M-Pesa at the published rate.
- The fee, the billing cycle, and the till number / Daraja shortcode in effect are shown on the /billing page.
- Failed or late payments push the organization into a 7-day grace period during which the data is still readable but new writes are blocked. After grace ends without payment, the organization becomes expired and only the /billing page remains reachable.
- Payments are processed by Safaricom M-Pesa Daraja. We rely on the transaction record returned by Safaricom; manual M-Pesa codes you submit are verified before extending your period.
- Subscriptions are non-refundable, but you can cancel at any time and continue using the paid period you have already purchased.
- We may change the fee with at least 30 days’ written notice (email to the address on file). If you don’t agree to the new fee, you may cancel before it takes effect.
5. Acceptable use
You agree not to:
- Use StockIt for any activity that is illegal under Kenyan law or the law of the country you operate from.
- Upload malware, spam, or content that infringes a third party’s intellectual-property or privacy rights.
- Probe, scan, or attempt to bypass the security of the service, or access another organization’s data.
- Reverse-engineer, scrape, or resell the service in a way not expressly permitted by these terms.
- Use the service to send unsolicited marketing or otherwise violate the Kenya Data Protection Act, 2019.
We may suspend or terminate accounts that breach this section without notice if the breach is serious or ongoing.
6. Your data
You own the data you put into StockIt.We don’t claim ownership of your products, customers, sales, employees, inventory, or receipts. You grant us a limited licence to host and process that data for the sole purpose of providing the service.
How we handle personal information is described in our Privacy Policy. Where we process personal information about your customers or employees on your behalf, we act as your processor under the DPA.
7. Our platform
We own the StockIt application, its codebase, documentation, and brand. Nothing in these terms transfers any of that to you. We also keep aggregate, non-identifying usage statistics about how the product is used.
8. Availability and support
We aim to keep StockIt available 24/7 but we do not guarantee a specific uptime in this version. Planned maintenance is announced in advance where practical. Support is provided over email at the address in Section 14 on a best-effort basis during East Africa business hours.
9. Confidentiality
Each of us may receive information from the other that is not public (for example, business records you store in StockIt, or non-public roadmap information we share with you). Both sides agree to use such information only for the purposes of this agreement and to protect it with the same care they use for their own confidential information.
10. Termination
- By you. You may cancel at any time from the organization settings page. Cancellation stops future billing; you keep access until the paid period ends.
- Account deletion. An admin may request full deletion of the organization from the organization settings page. After a 30-day grace period (during which deletion can be cancelled by the same admin), all the organization’s data is permanently removed, except for records we are legally required to retain (e.g. financial records for KRA).
- By us. We may terminate the account if you breach these terms, fail to pay, or use the service in a way that risks the platform or other tenants. We will give written notice and a chance to cure where the breach is curable.
- You may export your data at any time from the organization settings page before deletion takes effect.
11. Disclaimers
The service is provided as is and as available. We don’t warrant that the service will be uninterrupted, error-free, or that it will meet your specific business requirements. StockIt is a record-keeping tool — it does not replace professional accounting, tax, or legal advice.
12. Limitation of liability
To the maximum extent permitted by Kenyan law, neither party is liable to the other for any indirect, incidental, special, consequential, or punitive damages, or for loss of profit, revenue, goodwill, or business opportunity, arising out of or in connection with these terms.
Our total aggregate liability arising out of or related to these terms in any 12-month period is capped at the total subscription fees paid by your organization to us in that period.
Nothing in this section limits liability for fraud, gross negligence, or any other liability that cannot be excluded by Kenyan law.
13. Governing law and disputes
These terms are governed by the laws of the Republic of Kenya. Any dispute that cannot be resolved by good-faith discussion within 30 days will be submitted to the exclusive jurisdiction of the courts of Kenya at Nairobi.
14. Contact and changes
For any question about these terms, write to info@mw-labs.com.
We may update these terms when the service, the law, or our commercial arrangements change. Material changes are notified to the email address on file for your organization at least 14 days before they take effect. Continuing to use StockIt after that date means you accept the new terms.
